“Nous avons actuellement 159 demandes qui sont pendantes. Cent autres sont suspendues pour ne pas avoir rempli les conditions nécessaires”, a confié au Newtimes Damascène Rusanganwa, officiel du Service d’Immigration en charge d’examen de demandes de naturalisation.
Ces nombreuses demandes d’acquisition de la nationalité rwandaise surviennent à la faveur de l’amendement de la loi sur la naturalisation rwandaise de juillet 2008. Au paravant, il y avait une clause qui statuait que pouvait acquérir la nationalité rwandaise seul un enfant ayant un père rwandais et une mère étrangère. Cette clause a été remplacée par une autre accordant la nationalité rwandaise à tout enfant dont l’un des parents est rwandais.
La même loi accorde une nationalité rwandaise sur demande à tout étranger âgé de 18 ans et plus né au Rwanda de parents étrangers résidant au Rwanda. Cette loi précise aussi qu’est automatiquement Rwandais toute personne née au Rwanda de parents inconnus ou étrangers ou un enfant qui ne peut acquérir la nationalité de l’un de ses parents.
La nationalité rwandaise est aussi octroyée, trois ans après, à une personne de nationalité étrangère mariée légalement à un Rwandais.
A part ces catégories, tout étranger soucieux d’acquérir la nationalité rwandaise peut en exprimer la demande et satisfaire aux conditions exigées par la loi. Une clause complémentaire à celle-ci stipule qu’au cas où l’Etat rwandais juge qu’il a intérêt en telle personne, sa demande de nationalité rwandaise est vite agréée.
Il est rapporté que le Gouvernement rwandais est entrain de concevoir un projet de loi sur la nationalité rwandaise. Il y est question de spécifications de critères d’éligibilité à la nationalité rwandaise de toute personne ayant des talents particuliers, des capitaux et d’autres grandes activités participant au développement durable du Rwanda.
Ce projet de loi fort de ses 58 articles est déjà en attente d’approbation du Parlement-Chambre des Députés. Une fois votée, cette loi remplacera la loi organique n030/2008 traitant d ela question de la naturalisation rwandaise.
