The Congolese justice system is engulfed in a complex situation following the refusal by two constitutional judges to take oath before the Head of State.

Two judges of the constitutional court Jean Ubulu Mpungu and Noël Kilomba Ngozimala appointed Presidents of the Court of Cassation by an order of the Head of State Félix Tshisekedi on July 17, 2020 refused to take the oath, this Tuesday.

According to details they want to stay at the Constitutional Court to complete their constitutional mandates there while their oaths were scheduled for Tuesday 04 August 2020.

These two judges estimate that the respective terms of the constitutional court are nine (9) years for each, and are still in progress.

“Allow us, nevertheless, to inform your Very High Authority that in accordance with the Constitution, in its article 158, paragraph 3, and with the Organic Law no 13/026 of October 15, 2013, on the organization and functioning of the Court Constitutionally, in its article 6, our respective Mandates are nine (9) years for each, and are still in progress,” the judges said in a joint communiqué.

Foremost, the two judges argue that although they were appointed by the President, they claim were not consulted.

The assistant to the President of the Republic, Michée Mulumba, considers that Judges Kilomba and Ubulu refusing to go to the Court of Cassation for not having completed their mandates at the Constitutional Court amounts to pure manipulation which results from a failure after their appeal against their departure from the High Court.

Rwandans on Wednesday begun online bidding for properties lined up for public auction bringing an end to age old cumbersome and emotional method that involved physical presence of bidders at the site of property.

For any property available for auction valued at or above Rwf5million, interested bidders from wherever they are required to first deposit 5% of the price (reference price) as bid security. This is also refundable.

This new system is aimed at preventing any form of manipulations, influence peddlers and various forms of corruption previously experienced in analogue public auctions.

Martine Urujeni the Head of the Access to Justice Services in the Ministry of Justice explains that the new online method aims at weeding out ‘mafia rings’ formed by some brokers to distort prices and value.

According to Urujeni, when a successful bidder pays the price within the time limits specified by law, he or she deducts the bid security from the price to be paid.

The law provides that interested bidders enter offer prices through the electronic system where they are kept confidentially. Six hours before the auction hour, the prices are disclosed, again through the electronic system and also submitted by email to both the bailiff and each bidder.

“This fee is deposited onto the bank account specified by the Ministry of Justice and is refunded if the bidder is not awarded the property in question within three working days,” Urujeni was quoted in an interview with a local publication.

Meanwhile, Richard Kayibanda the Registrar General says, “It will be easier, faster and more transparent. The client can place their bid at any time and will be able to see the bidding results at the opening time, which will be communicated through email.”

The Ministry of Justice, in partnership with the Rwanda Development Board (RDB), today launched a digital bidding platform that is aimed at making the enforcement of orders efficient and transparent.

The platform, accessible at https://cyamunara.gov.rw/auction/ will reduce the processes involved in the enforcement of orders and curtail malpractices occasioned by human interaction.

Additionally, the platform will make it possible for potential bidders outside the country to participate in the auction exercise.

Speaking at the launch, Johnston Busingye, Minister of Justice and Attorney General, said that the platform is a long-term solution to the challenges faced in the execution of enforcement of orders.“I would like to commend RDB and other partners for working closely with the Ministry of Justice to effect change in the execution of enforcement orders, from a manual to an electronic system that is in line with the Government’s vision of digitalizing all its services,” he said.

Clare Akamanzi, the Chief Executive Officer of RDB, said that over the last 10 years, Rwanda has implemented focused reforms aimed at improving the doing business environment for the private sector to thrive.

“Private sector contribution to the economic development of Rwanda is primary. We cannot talk about development without developing the private sector; activities such as this help the private sector to thrive in our economy.

The net outcome of the electronic system is to improve the quality of auctions and recovery rate. We hope that this system will help banks and the private sector in general to thrive.”

The new Registrar General instructions on Management, Lease, Auction, and Take-over of mortgages, in addition to electronic auctioning of collateral, also provide for a bid deposit to ensure that only genuine bidders participate in the auction.

The instructions also provide for a possibility for the property owner to object to the price if it is less than 75% at the first and second rounds of auction.
